TERMS OF SALE - NAKED HOCKEY ON DECATHLON MARKETPLACE OVERVIEW Naked Hockey is a trading name of JRMJ Ltd. Throughout these Terms of Service, the terms "Naked Hockey", "we", "us" and "our" refer to JRMJ Ltd. These Terms of Service apply to the sale of Naked Hockey products by us to you via the Decathlon online marketplace ("Decathlon Marketplace"). Decathlon Marketplace is operated and controlled by Decathlon and your use of the Decathlon website and marketplace is also governed by Decathlon's own terms and policies. Those terms apply in addition to, and do not form part of, these Terms of Service. By purchasing Naked Hockey products via Decathlon Marketplace, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced here or made available to you in connection with our products. These Terms apply to all customers purchasing our products via Decathlon Marketplace. Please read these Terms of Service carefully before placing an order for our products on Decathlon Marketplace. By placing an order or otherwise purchasing our products, you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions set out here, you must not purchase our products via Decathlon Marketplace. Any new features, services or product ranges that we make available via Decathlon Marketplace will also be subject to these Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service. Where required, we will notify Decathlon so that updated terms can be made available to you on Decathlon Marketplace. It is your responsibility to review the applicable terms as published from time to time. Your continued purchase of our products via Decathlon Marketplace following any changes constitutes acceptance of those changes. Decathlon provides the marketplace platform that allows us to sell our products and services to you. Decathlon is responsible for the operation and security of Decathlon Marketplace and for any services it provides to you as platform operator. SECTION 1 - ONLINE MARKETPLACE TERMS By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state or province of residence, or that you are the age of majority and you have given your consent for any of your minor dependants to purchase our products via Decathlon Marketplace. You may not use our products for any illegal or unauthorised purpose nor may you, in connection with the purchase or use of our products, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not misuse Decathlon Marketplace or our Service, including by introducing viruses, malware or other harmful code. Any breach or violation of these Terms may result in the suspension or termination of your ability to purchase our products via Decathlon Marketplace, without prejudice to any other rights or remedies we may have. SECTION 2 - GENERAL CONDITIONS We reserve the right to refuse to accept or fulfil any order for our products at any time and for any reason, including in accordance with applicable law and any policies operated by Decathlon for the Marketplace. You understand that any content or information you provide in connection with your order for our products (excluding payment card information, which is handled by Decathlon and/or its payment providers) may be transferred unencrypted and may involve transmissions over various networks, and changes to conform and adapt to technical requirements of connecting networks or devices. You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of our Service, your access to our Service, or any contact with us in connection with our Service, without our express written permission. Headings in these Terms of Service are for convenience only and do not limit or otherwise affect their meaning. SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION We are not responsible if information made available about our products on Decathlon Marketplace is not accurate, complete or current, except as required by law. Product information is provided for general information only and should not be relied upon or used as the sole basis for making purchasing decisions without consulting more accurate, more complete or more timely sources of information where appropriate. Any reliance on material relating to our products is at your own risk. Decathlon Marketplace may contain certain historical information about our products, including past ranges or prices. Historical information is not current and is provided for your reference only. We reserve the right to modify information about our products at any time, including specifications and availability, but we have no obligation to update any information except where required by law. You agree that it is your responsibility to review the product information and any applicable terms before placing an order. SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES Prices for our products on Decathlon Marketplace are subject to change without notice, in accordance with applicable law. We reserve the right at any time to modify or discontinue any product or product range offered via Decathlon Marketplace, without notice and without liability to you, subject always to our obligations in respect of orders already accepted. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of any of our products or related services, except as required by law. SECTION 5 - PRODUCTS OR SERVICES Certain products or services may be available exclusively online via Decathlon Marketplace. These products or services may have limited quantities and are subject to return or exchange only in accordance with our Refund and Returns Policy and any applicable Decathlon Marketplace policies. We have made every effort to display as accurately as possible the colours and images of our products shown on Decathlon Marketplace. We cannot guarantee that any device's display of colour will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction, subject to applicable law and any rules of Decathlon Marketplace. We may exercise this right on a case by case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products and pricing are subject to change at any time without notice, at our sole discretion and in line with applicable law. We reserve the right to discontinue any product at any time. Any offer for any product or Service made via Decathlon Marketplace is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your individual expectations, or that any errors will be corrected, save as required by law or expressly stated by us. SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION Orders for our products are placed via Decathlon Marketplace. Decathlon is responsible for managing the checkout process and collecting payment in accordance with its own terms and policies. We reserve the right to refuse any order for our products placed via Decathlon Marketplace. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order, including in line with Decathlon's policies. These restrictions may include orders placed using the same customer account, the same payment card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may notify you via the contact details provided with your order and/or via the order management tools made available by Decathlon. You agree to provide current, complete and accurate purchase and account information to Decathlon for all purchases made via Decathlon Marketplace, and to promptly update such information so that your transactions can be completed and you can be contacted as needed. SECTION 7 - OPTIONAL TOOLS Decathlon may provide access to third party tools or services via Decathlon Marketplace. We do not control and are not responsible for such tools or services unless expressly stated otherwise. You acknowledge and agree that any such tools are provided "as is" and "as available" without any warranties, representations or conditions of any kind from us and without any endorsement from us. We shall have no liability whatsoever arising from or relating to your use of optional third party tools provided via Decathlon Marketplace. Any use by you of optional tools offered via Decathlon Marketplace is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third party provider. SECTION 8 - THIRD PARTY LINKS Certain content, products and services relating to our brand or offered via Decathlon Marketplace may include materials from third parties. Third party links may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of such third party materials and we do not warrant and will not have any liability or responsibility for any third party materials or websites, or for any other materials, products or services of third parties, except to the extent required by law. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content or any other transactions made in connection with any third party websites. Please review carefully the third party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns or questions regarding third party products should be directed to the third party. SECTION 9 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS If, at our request, you send certain specific submissions (for example contest entries) or, without a request from us, you send creative ideas, suggestions, proposals, plans or other materials, whether via Decathlon Marketplace messaging tools, by email, by post, or otherwise (collectively, "comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you provide to us. We are and shall be under no obligation: (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable, or which violates any party's intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third party, including copyright, trade mark, privacy, personality or other personal or proprietary rights. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could affect the operation of any service or website. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party. To the extent that we receive and process your personal information as a seller (for example for customer service or warranty purposes), our own Privacy Policy will also apply. SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS Occasionally there may be information relating to our products or services on Decathlon Marketplace that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information relating to our products is inaccurate at any time without prior notice, including after you have submitted your order, subject to our legal obligations and any requirements of Decathlon Marketplace. We undertake no obligation to update, amend or clarify information relating to our products, including pricing information, except as required by law. No specified update or refresh date should be taken to indicate that all information has been modified or updated. SECTION 12 - PROHIBITED USES In addition to other prohibitions as set forth in these Terms of Service, you are prohibited from using our products or any related content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, national, provincial, state or local regulations, rules, laws, or ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that may affect the functionality or operation of any service or website; (h) to collect or track the personal information of others in a way that breaches applicable data protection laws; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent any security features of Decathlon Marketplace or any related website or service. We reserve the right to request that Decathlon restrict or terminate your ability to purchase our products for violating any of the prohibited uses, and to pursue any other remedies available to us. SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY We do not guarantee, represent or warrant that your purchase or use of our products will be uninterrupted, timely, secure or error free. We do not warrant that the results that may be obtained from the use of our products or services will be accurate or reliable, save as required by law. You agree that we may from time to time suspend the sale of our products, remove products from Decathlon Marketplace or cease selling via Decathlon Marketplace at any time, without notice to you, subject to applicable law. You expressly agree that your purchase and use of our products is at your sole risk. Our products and any related services made available via Decathlon Marketplace are (except as expressly stated by us or required by law) provided "as is" and "as available", without any representations, warranties or conditions of any kind, either express or implied, including any implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non infringement. Nothing in these Terms of Service is intended to exclude or limit any rights you may have as a consumer under applicable mandatory law, including your statutory rights in respect of defective products. In no case shall JRMJ Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including, without limitation, loss of profits, loss of revenue, loss of savings, loss of data, replacement costs or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your purchase or use of any of our products or services, or for any other claim related in any way to your purchase or use of our products or services, including but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of our products or any content made available in connection with them, even if advised of their possibility. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law. SECTION 14 - INDEMNIFICATION You agree to indemnify, defend and hold harmless JRMJ Ltd and our parent companies, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from and against any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party, except where such claim arises from our own negligence or wilful misconduct. SECTION 15 - SEVERABILITY If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions. SECTION 16 - TERMINATION The obligations and liabilities of the parties incurred prior to the date of termination shall survive the termination of these Terms of Service for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may stop purchasing our products at any time. If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may request that Decathlon restrict or terminate your ability to purchase our products via Decathlon Marketplace, without notice, and you will remain liable for all amounts due up to and including the date of termination. SECTION 17 - ENTIRE AGREEMENT The failure by us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules we publish in connection with our products on Decathlon Marketplace constitute the entire agreement and understanding between you and us in respect of your purchase of our products via Decathlon Marketplace, and supersede any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us in respect of such purchases. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party. SECTION 18 - GOVERNING LAW These Terms of Service and any separate agreements whereby we supply products or services to you shall be governed by and construed in accordance with the laws of Northern Ireland, without prejudice to any mandatory consumer protection laws that apply in your country of residence. SECTION 19 - JURISDICTION You acknowledge and agree that the courts of Northern Ireland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with our Service, these Terms of Service, their subject matter or formation (including non contractual disputes or claims), without prejudice to any rights you may have under applicable consumer protection law to bring proceedings in your country of residence. SECTION 20 - CHANGES TO TERMS OF SERVICE We reserve the right, at our sole discretion and subject to applicable law, to update, change or replace any part of these Terms of Service. Where updated terms apply, we will notify Decathlon so they can be made available to you on Decathlon Marketplace. It is your responsibility to check the applicable terms as made available by Decathlon from time to time. Your continued purchase of our products via Decathlon Marketplace following the posting of any changes to these Terms of Service constitutes acceptance of those changes. Les articles doivent être inutilisés, non lavés, dans leur état d'origine, avec l'emballage d'origine et toutes les étiquettes. Pour les crosses, le film plastique rétractable sur la tête doit être intact. Articles non retournables Sauf défaut ou non-conformité: cartes-cadeaux, produits personnalisés/sur mesure, articles scellés non retournables pour raisons d'hygiène si le sceau a été retiré après livraison. Articles défectueux ou incorrects En cas de dommage, défaut ou description incorrecte, contactez-nous dès que possible avec votre numéro de commande, une description et des photos claires. Si le défaut est confirmé, nous réparons, remplaçons ou remboursons conformément à notre garantie et au droit applicable. Lorsque la loi l'exige, les frais de retour raisonnables seront remboursés. Vous restez responsable des articles jusqu'à réception; emballez-les soigneusement et conservez la preuve d'envoi et le numéro de suivi. Remboursements Après réception et inspection, nous confirmerons par email l'approbation du remboursement. Les remboursements approuvés sont traités sans retard injustifié, via le mode de paiement d'origine si possible. Pour un retour par changement d'avis, nous remboursons le prix du produit et, si la loi l'exige, la livraison standard. La livraison améliorée et les frais de retour ne sont pas remboursés. Cette politique n'affecte pas vos droits légaux.
Dès réception de votre retour et après vérification de celui-ci, nous nous engageons à vous rembourser sous 4 jours maximum selon le mode de paiement utilisé lors de votre achat.
Si vous souhaitez retourner votre commande, vous pouvez le faire sous 30 jours après réception de celle-ci. Une étiquette de retour est présente dans le colis de réception de la commande ? Nous vous invitons à suivre les instructions disponibles sur l’étiquette de retour, tout en renvoyant la commande dans son emballage d’origine. Si aucune étiquette n'est présente dans le colis de réception de la commande, nous vous invitons à aller sur votre compte client Decathlon.fr et de vous rendre dans la rubrique “Mes achats”. Cliquez sur la commande que vous souhaitez retourner, puis sur “Faire mon retour”. Suivez les étapes, cela enverra un message automatique du souhait de votre retour auprès du vendeur. Vous recevrez alors sous 72 heures ouvrées les instructions de retour. Si vous ne trouvez pas cette option ou si vous souhaitez plus d’informations, vous pouvez également contacter le service client Decathlon.fr. Les retours de produits Marketplace ne sont pas possible dans les magasins et entrepôts Decathlon.
Les produits achetés sur Decathlon.fr bénéficient d’une garantie de deux ans à partir du jour où le client prend possession de ceux-ci. La garantie est valable pour autant qu'elle soit due à un défaut causé par l'utilisation normale du produit ou à un défaut de fabrication. Il est nécessaire de joindre tous les documents nécessaires à l'activation de la garantie ou d'une éventuelle extension de garantie (facture d'achat, photos, clips audio,...).
Cette garantie commerciale s'ajoute à vos droits légaux et ne les affecte pas (y compris toute garantie légale pouvant s'appliquer dans votre pays). Crosses de hockey: garantie 6 mois (à partir de la livraison) contre les défauts de fabrication en usage normal. Garantie casse: 3 mois. Usure esthétique non couverte (éclats, rayures, grips/embouts usés, cliquetis ou fragments internes). Sont aussi exclus les dommages dus à une mauvaise utilisation, chocs répétés avec d'autres crosses, impacts sur surfaces dures ou terrains inadaptés. Sacs et accessoires: garantie 12 mois contre les défauts de matériaux et de fabrication en usage normal. Non couvert: surcharge, abrasion, frottements/traînage, mauvais entretien, modification ou usure esthétique normale. Vêtements: garantie 6 mois contre les défauts de fabrication (coutures, surpiqûres, fermetures éclair, impressions). Non couvert: usure normale, lavage/séchage incorrect, accrocs ou décoloration à l'usage. Réclamation: contactez [email protected] avec votre numéro de commande, des photos claires et une description du problème. Nous pouvons demander un retour pour inspection. Si la réclamation est acceptée, nous réparons, remplaçons ou remboursons, à notre discrétion et conformément au droit de la consommation applicable.
